Terms and Conditions

These terms and conditions apply to any orders, online orders, retail location, & phone orders. 

By agreeing to the terms and purchasing the product(s) stated herein, you certify that you are at least 18 years of age and have fully read, understand and agree to be legally bound by all of the terms and conditions stated herein. If for any reason you do not agree to these terms, the checkout/purchases will not be allowed.

Free shipping is to USA addresses only. (Canada, Hawaii, Puerto Rico, Alaska, and some USA addresses are subject to additional shipping charges or surcharges (additional fee's). Please email sales@minisplitwarehouse.com if you are in these area's so we can confirm your additional shipping costs).

Verification
You certify that you are authorized to use the credit card provided at checkout. You agree to provide additional proof of your identity if needed by the merchant processor for our credit card processing (not limited to a copy of the credit card and a copy of your identification). We reserve the right to cancel your order for any reason. 

Product Warranty Important Notice
NON-DIY HVAC systems and components are designed to be installed by qualified HVAC technicians, otherwise no warranty is offered or honored.  The installation of HVAC systems includes electrical, gas, and refrigerant connections, is generally regulated by a multiple sets of laws,  codes and guidelines, at the federal, state and local levels. Further, the failure to properly install HVAC equipment can raise personal  safety and performance concerns. Further, no warranty is offered for the products that were installed by unlicensed or unauthorized persons. As outlined, the failure to comply with this policy could lead to violations of applicable law that are punishable by fines. All warranty activation must be completed within 30-60 days of your installation (Depending on the Manufacturer), otherwise you void your factory warranty and any other warranty. 

Purchaser hereby acknowledges that federal law prohibits opening the refrigeration lines of any equipment purchase. A properly licensed person must handle the refrigerant contained in any unit/system. Purchaser hereby assumes full responsibility and risk for the safe and proper installation in accordance with applicable local, provincial and Federal code, rules, regulations and requirements. By purchasing any item,Via Phone, in person Or By Online ordering,  the purchaser acknowledges that he/she/it has read and agrees with all of the policies, terms and conditions stated herein. No modifications to the terms contained herein shall be valid unless in writing and signed by our authorized agent. Purchaser hereby agrees to not hold this corporation or the officers and stock holders responsible for any product miss-labeling or typographical errors on factory boxing and stickers. Factory boxing and stickers are applied by the factories, not the corporation.  Purchaser agrees to not pursue legal action for any reason against this corporation or any of its associated officers/ stockholders. Should the purchaser decide to pursue legal action against this corporation(MiniSplitWarehouse.com INC ) or any of the corporations shareholder or officers, before returning the product to one of our locations, purchaser hereby agree's to pay all court cost and legal fee's associated with the litigation process- This includes the fee's of the court and the corporations lawyers fee's. Purchaser agree's that if the terms and conditions are not followed as agreed to at checkout, they waive their rights to credit card chargebacks/arbitration and will not hold the seller responsible for any refunds/replacements.   

IMPORTANT DELIVERY INSTRUCTIONS

*ALL FREIGHT SHIPMENTS MUST BE OPENED & INSPECTED AT TIME OF DELIVERY, REJECT IF DAMAGED OR NOTE ALL DAMAGES ON SIGNATURE FORM.

If you accept and sign for the delivery, then notice damages afterwards, YOU HAVE ONLY 5 DAYS FROM THE DELIVERY DATE TO REPORT HIDDEN DAMAGES - You will need to contact both the shipping company and Minisplitwarehouse via email and provide pictures of the boxes before you opened them, and after showing the damages to the box and to the product. If you do not report this within 5 Days you hereby agree to not hold the merchant MiniSplitWarehouse or its suppliers responsible for damages. 

Important Steps to follow when receiving your delivery:
1. Take delivery ticket from driver.
2. Open and inspect each box for damages and compare the packing list box count to the quantity of boxes delivered. Refuse the delivery if the damages are too extensive.
3. Sign delivery ticket and NOTE ANY DAMAGES, including minor damages to the boxes and/or ANY MISSING BOXES. 
4. Give signed & noted ticket to the driver, keep the carbon copy for your records.

*Should the driver not allow you to open & inspect the delivery, please write on the BOL that the driver makes you sign "Refused Due to Damages, Driver DID NOT ALLOW Inspection" and be sure to note any external damages seen on the boxes (no matter how small).

**Please note, when you receive your item, prior to signing for it, please make sure to verify the following:

(a) the condition of the shipment and note any damage on the Carrier's waybill/delivery slip; If there are any damages please make sure you note it on the proof of delivery the driver will make you sign, and get a copy for yourself. Non reported/noted damage would result in client's responsibility to file a claim with the shipping company.

(b) Verify the number of pallets/cartons/boxes/pcs delivered coincides with numbers shown on the Carrier's waybill/delivery slip; Immediately report any damage or shortages to the Customer Service Department at MiniSplitWarehouse.com. If the damages are not reported upon delivery the claims department will decline your claim submission. We must be notified immediatley if there are any missing boxes, or damages. These damages or missing boxes MUST BE noted on the delivery ticket.

**Refusing a delivery due to damages: If the product is damaged, once we receive it back to our warehouse, we will send out a replacement in 24-48hrs. If the customer requests that we do not ship out a replacement, it will be treated as a cancelation of the order. 


Shipping**********************************************************************
Flat rate shipping, if offered, only apply to the 48 contiguous States . They do not apply to Hawaii, Alaska and Puerto Rico or Canada territories. Please contact us for rates to those locations. Shipping method shall be ground/freight shipping by the carrier of our choice. Tracking numbers will be available after the product is picked up by the freight company. All items will be shipped to the purchaser's address as entered onsite. IMPORTANT: WE REQUIRE A TELEPHONE NUMBER SO THAT THE FREIGHT COMPANY CAN CONTACT YOU AND MAKE AND APPOINTMENT FOR DELIVERY. Please make sure to provide your telephone number, along with a valid address on our website and on your credit card transaction. We are not responsible for errors or inconsistencies in said addresses. Incorrect information will result in a delay on your delivery. All items are shipped Free on Board (FOB) at our warehouse, freight prepaid. The customer takes title to the goods at the time of shipment. WE ARE NOT RESPONSIBLE FOR TRANSIT DELAYS. Should you decide to use your own shipper, we are not responsible for any damages to your product, in the event you discover damages to your shipment after using your own shipper, you will need to file a claim with your shipper. Surecharges: some areas are subject to surecharges due to the state charging extra for shipments sent to those states. 

Freight Forwarder: In the event the purchaser/cardholder decides to use a freight forwarder to transport the air conditioner order to the final destination- the cardholder agree's to not hold the merchant, Minisplitwarehouse.com inc, responsible for any shipping damages caused during transport. The purchaser/cardholder agree's to file a claim with the freight forwarder direct for any shipping damages. The purchaser/cardholder agree's to make sure the shipment is fully insured by the freight forwarder for this reason. The cardholder/purchaser agree's to have the freight forwarder inspect the shipment at the time of delivery, before sending to the final destination- if any damages are noticed, the freight forwarder is to mark the damages on the delivery ticket and refuse the order allowing the merchant to file a claim and send a replacement. 

International Shipping
For shipments to locations outside the United States, the purchaser shall be responsible for custom clearance, duties, brokerage fees, taxes and other incidental charges. It is the responsibility of the purchaser to determine whether each product is suitable for import and use into their jurisdiction. For export documentation purposes, we CANNOT accommodate requests to declare the purchased item as "gift" or "sample" or undervalue the purchase amount as they are in contravention of Canadian and US law.
 
Shipping Insurance
We use the most reputable carriers for the shipment of each order. Nevertheless, despite the best care and proper packaging, accidents do happen. Depending on the item, shipping insurance may be required as an added option. If shipping insurance is provided as an added option and declined by the customer, please note that we, nor the carrier, are under any circumstance, responsible for loss or damage incurred during the course of shipping. Upon receipt of the order, the purchaser/recipient is hereby requested to open the packaging and inspect the shipment thoroughly and completely for damage. All visible damage and/or nonconformity, regardless of its severity, size or significance must be noted on waybill or other shipping documents by the customer. Failure by the purchaser/recipient to note any damage, defect or irregularity in the shipping documents shall be construed as a declaration by the purchaser/recipient that the goods were received in good order and condition and free from any defect or non-conformity. If there is significant damage resulting from mishandling of goods by the shipping carrier, the customer is hereby asked to refuse the shipment. Additionally, the customer must notify us, in writing, within 24-48 hours of receipt of damaged, non-conforming product. In the event of shipping loss or damage, it is the sole responsibility of the purchaser to file for an insurance claim and we will offer all necessary assistance to the purchaser for that purpose. Minor cosmetic damages that do not impact the operation or safety of the unit are expressly excluded under the terms of any return, warranty and/or insurance policy.

Cancelations After Shipping
***Should you decide to cancel/refuse your order for ANY reason AFTER your product has shipped out (Besides Shipping Damages as Stated Above), you will be responsible for the freight charges, the credit card processing charges, and a restocking fee up to 25% (Depending on the Manufacturer/Supplier Rules).
 
Sales tax/Surcharges:
Our system will not allow rates by zip codes, so sales tax for your state is set to a rate based upon the most populated city in your state. Refunds for the difference can be issued upon request if your rate is lower than we charged (within 30 days). However, if the rate we charged is under your citys rate, then we will reach out to you and collect difference. Surcharges are applied to orders going to states that require additional fee's and compliance charges for shipments/orders being delivered into the state. 

ChargeBack/Credit Card Disputes
In the event that you may initiate a chargeback or credit card dispute via your credit card company before returning the product/order back to us, you hereby agree to reimburse MiniSplitWarehouse.com Inc for all costs and fee's associated with your chargeback - not limited to Legal Fee's, product cost & shipping expenses. Furthermore, if the product is not returned to us you agree that your credit card company will not hold the merchant responsible for any refund/credit until the product has been returned in the same condition it was delivered. If the chargeback is initiated due to any faulty product, you agree to have this faulty product reported properly to the manufacturer to get it covered under the factory warranty, and do not hold the merchant responsible for any defective product. Defective product will be replaced under the manufacturers warranty.

Returns/Exchanges
Unopened/Un-Used returns are accepted within the first 30 days of the purchase date (Buyer pays all freight charges, original outgoing and the return). Exchanges of indoor units are subject to the same rules, return shipping is paid for by the customer and the new shipping charge of the exchange or change order is also the customers responsibility, along with any price difference between the indoor units. . All other opened or installed products: exchanges for defective products/components are made by the manufacturer under their warranty. 

Unopened Returns 
Systems have a 30 Day Return Policy (Parts cannot be returned, only exchanged if defective)

*Conditions *
1. Product must be in its original box, unopened and un used.
2. Product must be shipped back with all of its original shipping contents (manuals, brochures etc).
3. Product must be shipped back palatalized, shrink wrapped, strapped and secured safely to the pallet.

The customer is responsible for all shipping, handling and insurance costs back to our warehouse(s) within the 30 day period. Original Shipping cost we paid to ship it out to you cannot be refunded. 

It is the customers sole responsibility that we receive the product in its original undamaged condition, Proof of delivery must be provided with a signature from our warehouse.
We must authorize the return before it is shipped back from the Customer. Other Conditions may apply.

All Returns are carefully inspected upon receipt. Exchanges are administered based on the conditions stated above. All Products must be in the original packaging and must not have been, used, modified or installed. Please note that refunds/exchanges are made as follows: If customer cancels the order and the product has left our warehouse, the customer is responsible for the shipping charges for all items to and from us, in addition the above stated restocking fee. If product is being returned after it has been received by the customer, and the product is returned with opened boxes or product shows signs of wear, we have the sole discretion in determining the amount (if any) of any refund. This includes any scratches or marks on product (screws or screw hole areas) wires bent or cut, etc. Under these circumstances if the refund amount is not acceptable by the purchaser, the purchaser has the option to pay a shipping charge and have the item sent back to him/her/it. We do not recommend sending used or damaged items back to us as normally refund will be refused. We may at our discretion, refuse to accept the return. If the product is returned with missing, damaged, dirty, bent, non-working parts or the item appears to have been installed no refund will be honored. 

USED or INSTALLED system returns are not accepted. To the extent we may be compelled to allow an installed/used return, they are subject to a minimum 30% stocking fee (if product is still in working order). The original outgoing shipping and handling charges are always non-refundable, and the return shipping charges are to be paid for by the customer or their technicians.  

Factory Warranty/Technical Support

New Product Warranty: A manufacturer's limited warranty is furnished from the date of purchase warranting the product to be free of material defect. In the event of product failure or malfunction, the purchaser agrees to have their licensed HVAC technician contact technical support for the brand purchased, in order to trouble shoot and repair the problem. Customer is responsible for the labor involved with the technicians troubleshooting and repairs. The purchaser shall return the defective/faulty product or component/part thereof to our designated repair facility for inspection (at the manufacturers request). The faulty/defective product component/part will then repaired or replaced . The repaired/replaced component shall then be returned to the purchaser. The purchaser shall be responsible for all shipping and handling costs of returning (both ways) faulty products or parts to us for replacement or repair. Certain items, which are subject to normal wear and tear, are specifically excluded from this warranty. We shall not be responsible for faulty installation, installer neglect, operation or maintenance of the product and as such, the manufacturer REQUIRES installation, assembly, repair and maintenance only by certified and qualified HVAC professionals. We reserve the right to require proof of the same before honoring any parts warranty replacement/repair. Damage resulting from failure to use the product in a manner consistent with our/manufacturer’s recommendations shall render the limited warranty void. This limited warranty specifically excludes any consequential and/or incidental damages/product labeling errors. Failure to follow the manufacturers warranty & trouble shooting process will result in the product/component not being replaced.

Technical Support: Although we may provide technical assistance via telephone or email to the customer's HVAC technician, it is virtually impossible to troubleshoot all matters via telephone or remote assistance. As such, the offering by us of any technical assistance is made without any warranty or guarantee and provided on “as is” basis. Although we will try to provide technical support remotely (via telephone/email), in many circumstances the technical issue/problem may not be resolved despite our best efforts. As such, the purchaser expressly acknowledges, as an express condition of this sale, that the customer may be required to consult a professional technician for troubleshooting/repair/start-up and that any such consultation, shall be at the sole responsibility of customer and the customer shall bear all costs relative thereto. All such costs shall be the responsibility of the customer and we shall not be responsible for any costs or expenses related thereto. We reserve the right to make slight modifications necessary to the merchandise for product improvement, including cosmetic changes, changes in color. Colors as viewed on photographs or computer monitors may appear slightly different from the actual color of the product depending on the resolution of your monitor.

Local Cash Deals are sold "as is", no warranty is offered unless expressly written on the receipt of purchase. Local Cash deals are not limited to: discontinued models, open boxes, dent & ding specials. 

Sizing Your System Properly
We often help customers to size their systems over the phone, using the information supplied by the customers such as: Square Footage, Insulation, Windows, Ceiling heights, etc. Our sales reps take educated guesses on what would be best for the area. If the information supplied by the customer is incorrect, this could lead to a system that is too small for their area. Please make sure to supply us with correct information when asking for help to size your system. The only way to be certain of the actual size system you require, would be if your HVAC contractor does energy calculations for you, they will charge for this service. We are not responsible if the customer purchases a system too small for their area, as it is the customers responsibility to have the calculations performed by a licensed HVAC contractor.
